1. DEFINITION OF TERMS

“You” and “Your” means the person ordering Goods or using services provided from Causevapes, who must be 18 years of age or older.

“Account” means your details and shopping history which is created when you register to shop

“Deliver” means us delivering the goods that you order to the address stated in your order (and that address must be within areas we deliver) and “Delivery” and “Delivered” shall be interpreted accordingly.

“Let Us Know” means change or cancel Your order via our websites contact forms or any other form of communication listed on this website.

2.1 We may update the Site from time to time, and may change the content at any time. However, please note that any of the content on the Site may be out of date at any given time, and we are under no obligation to update it. 2.3 You are responsible for configuring your I.T Systems, computer software in order to access the Site. You should use Your own trusted virus protection software.

You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing Your identity to them. In the event of such a breach, Your right to use the Website will cease immediately.

3. Accessing Our Site

3.1 To place an order on Our Site You must be 18 years of age or older, require Delivery in a zone we deliver and you are an authorised user of the credit/debit card or paypal account that you used to pay for your order.

3.1 When You register You will create a username and password which You must use whenever You shop with Us. You must treat Your username and password as confidential and must not disclose it to any third party. Please keep this information in a safe place. You are responsible for all activities and orders made under Your password and username. If You think that someone else may either know or be using Your username and password, please contact Us immediately.

3.1 We reserve the right to decline a new customer registration or to suspend or disable Your Account at any time and at Our sole discretion especially when we believe the user is under 18.

4. Other Websites

Sometimes in order to improve your shopping experience with us we might provide links to other websites or resources. Causevapes LTD has no control over the contents of those sites and we cannot accept any responsibility for any issues that might arise for browsing such websites.

5. CONTRACT FORMATION BETWEEN YOU AND US

5.1 Once you have placed your order, you should receive an e-mail from us acknowledging that We have received your order. Please note this does not mean that your order has been accepted. All orders are subject to availability and acceptance by us.

5.2 After you submit your order, we immediately contact your bank or card issuer for authorisation to take payment from your account. We will not process your order until payment has been received in full. If we accept your order We will confirm this to you by sending you a further e-mail confirming the Product is being processed ready for dispatch at which point the contract between us (“Contract”) will be formed.

5.3 You become the owner of the goods once the delivery process is complete. Should you have any special delivery instructions such leave the parcel in a safe place or with your neighboors this information must be included in the order delivery notes section during checkout. We will not be held liable for any parcels that have been removed from your safe place without your authorization or parcels lost by your neighbours.

6. PRICE AND PAYMENT

6.1 The price payable for the Products shall be as shown on our site in pounds sterling (GBP), delivery charges are payable in addition and will shown separately during the checkout process.

6.2 We accept payment by debit card, credit card or Paypal. Supported cards will be shown at the bottom of our website.

6.3 You must pay for the Products and all applicable delivery charges, We will charge the card or the paypal account that you have chosen and you are authorised to use to pay for your order once           you reach the final billing page and submit your order.

6.4 In case of a pricing error that is obvious and unmistakable as such,we may end the contract, and refund to you any sums you have paid under the contract prior shipping the products to you.

6.5 If you have been provided with a valid voucher code, that code must be used during check out.

8. Events Outside Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control, such us strikes, other industrial action by third parties and natural disasters.

9. Governing Law

The conditions and any relationship established with you via this site shall be governed by and construed in accordance with Scottish Law and any disputes arising shall be subject to the exclusive jurisdiction of the Scottish Courts.

10. Liability

10.1 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.

10.2 We only supply the Products for domestic and private use. You agree not to use the product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

10.3 We do not in any way exclude or limit our liability for:

(a) death or personal injury caused by our negligence

(b) fraud or fraudulent misrepresentation

(c) any breach of the terms implied by the Consumer Rights Act 2015

(e) defective products under the Consumer Rights Act 2015

11. Reliance on information

Any information posted on our website should not be taken instead of the advice of a medical professional. Always consult with your GP if you are unsure about the use of the products we sell.
